New Trust Setup

In order to setup your new discretionary trust we will need some details from you. Please answer all of the following questions as best you can – if you’re not sure about anything, please let us know at the end of the form so we can check back with you and clear up any confusion.

HINT: unfortunately this form cannot be saved – I would recommend you make sure you’ve got all the required information before starting.

Some notes before you get started:

  • The Trustee controls the trust and makes decisions to manage the trust funds/assets. A trustee does not receive distributions from the trust.
  • The Beneficiary is eligible to receive distributions from the trust but does not make decisions or control the assets.
  • The Settlor is a person who helps you establish the trust and after that has no further involvement. The settlor should be someone who will never become a trustee or beneficiary in the future (so avoid anyone you think you might want to bring into the trust at a later date such as spouse, family, children etc)
  • The Appointor has the ability to add or remove trustees from your trust, so should be someone you can trust implicitly! Unlike the Settlor, they can also be a beneficiary or trustee of the trust.

If you don’t receive a confirmation message after submitting the form, don’t stress. Some browsers will block the confirmation pop-up (very annoying!) but if a blank form pops up on your screen after you submit then this also indicates that your form has been submitted and received at our end.
